A. 6:14 P.M. Chair Achiu called the meeting to order.

II. COMMUNITY CONCERNS REGARDING AGRICULTURAL ISSUES
Community member Thomas Milcarek expressed concern of illegal pesticides allegedly being used in farms in and air around areas in Mokulē`ia. Also noted he has seen turtles with tumor growths and suspects it is related to pesticide use in the area and potentially in the ocean water due to runoff (??)
Concerns continue to be shared regarding Agricultural Crimes of trespass, theft and vandalism. Police reports have been made on certain incidents however it seems the use of the Department of Law Enforcement (DLE) is uncertain. Chair Achiu suggested to invite DLE to a future meeting for discussion of their program and process. Chair will reach out to the director to coordinate.
III. COMMITTEE BUSINESS
A. Resolution 25-228 Land Use Ordinance Amendment Relating to Conditional Use Permits (CUP)
Chair Achiu explained Resolution 25-228 that was introduced by Council Member Weyer. The purpose of this Resolution was to ultimately determine the difference and or identify the uses that clarify/prompt a CUP MINOR vs a CUP MAJOR while also requiring the applicant to present the application whether a MINOR or MAJOR to the appropriate community board (Neighborhood Board Community Association etc.) where the activity would take place. The Resolution was not reported out and remains Pending in Zoning Committee
B. Resolution 26-17 Land Use Ordinance Amendment Relating to Conditional Use Permits(CUP)
Chair Achiu explained that this resolution is somewhat the same as Res 25-228 in that it is more focused on CUP’s directly related to Agritourism. Although this resolution passed Committee to be heard at Full Council where discussion can be had with input from DPP. This meeting will take place on Wednesday Feb 18, 2026 in Council Chamber. Of note, although the resolution will likely pass it will go through DPP and Planning Commission for consideration of potential amendments.
C. House Bill No. 1848 Relating to Land Use
Chair Achiu explained that this Bill was an attempt to require any petitioner for a district boundary amendment to get a certification from CWRM that thereʻs enough water resource available for whatever the proposed project woud need without causing harm to the aquifers and be able to provide the certification to the LUC. However, this Bill was deferred by the House WAL Committee on 2/3/2026
