Planning, Zoning & Environment (PZ&E) Committee
June 2024 Meeting Report
Chair, Donna Wong
1. A committee meeting was held in-person on June 18, 2024, chaired by Donna Wong and attended by committee members Kelli Ann Kobayashi, Steve Trecker, and Gary Weller.
2. A presentation on 146 S. Kalaheo SMA was given to the committee. Since all construction work will take place within the existing footprint of the two homes, which are setback approximately 40 feet from the ocean, the committee has no comments on this application.
3. Discussion on 1226 Mokulua Drive SMA and Shoreline Setback Variance. The 2021 EA was originally rejected because DPP demanded that DLNR signed-on as fee owner of the application, since the rubble riprap and concrete seawall that are to be repaired under these permits sit on a Non-exclusive Easement, which was renewed by the Board of Land and Natural Resources in 2014. Only after DLNR Land Division signed onto the Shoreline Variance application did DPP accept the SMA/SV application for processing.
a. Committee motion. The Kailua Neighborhood Board supports the following conditions on the SMA Major permit #2024/SMA-44 and Shoreline Setback Variance No. 2024/SV-1 for 1226 Mokulua Drive:
1. Prohibit artificial light from exterior light fixtures from directly illuminating or projecting across property boundaries toward the shoreline and ocean waters, except as otherwise permitted by HRS 205A-7.1(b)
2. Require exterior light fixtures to be fully shielded.
3. Require exterior lighting to be turned off when human activity is not occurring in the illuminated area.
4. The AECOS 9/14/20 study conducted for the EA observed nesting Wedged-tailed Shearwaters at 1226A Mokulua Drive. To protect the endemic Newell shearwater `Ua`u kani, the following conditions should be included in the SMA/SV application.
a. A visual survey for seabirds and burrow nests must be conducted prior to any construction activities.
b. If a burrow nest is discovered, work will cease within a minimum radius of 200 feet of the nest for a minimum of 100 to 115 days
c. If a nest with chicks is discovered, sometime between late October through the end of November, work will cease for the 100 to 115 as days as identified in the AECOS Report instead of the FEA recommended 30 days. (DEA pg 3-22)
5. Require the construction of a fence staked down across the sand scarp edge to deter additional burrowing of Newell shearwaters on the property
6. Limit project work and construction activities to daylight hours – from sunrise to sunset.
7. Require that only barbless fencing be used to avoid entanglement of Hawaiian hoary bats
8. Require identification of BMPs that will be used to remove unsuitable soils under foundations since the work will occur on the sand/ocean.
