Surface Encroachment Authorizations
Criteria
The standard ground cover on unimproved sidewalk areas is lawn grass or other vegetative ground cover with a maximum height of 4″, except vines or other planting which may be a tripping hazard. See C&C Standard Detail R-28 Note A.2
All other landscaping such as shrubs and gravel, objects such as stepping stones/pavers, and structures such as walls are considered non-standard and require an approved surface encroachment authorization.
Owners may be cited for unapproved surface encroachments particularly when the encroachments present a potential hazard to pedestrians and/or vehicular traffic pursuant to ROH Section 14-3.8.
In general, the following surface encroachments are not acceptable and will not be approved:
- Rocks (except gravel completely contained within existing planter strips and with 1-inch maximum diameter)
- Fruit trees (except coconut trees)
- Trees with poisonous or toxic characteristics (i.e. oleander, desert rose)
- Thorny plants (i.e. bougainvillea, cactus, palms with thorns)
- Paving for parking
- More than four lineal feet of hardscape as measured along the curb or roadway

Apply
Submit a completed application along with a non-refundable fee of $200 to request authorization of surface encroachment(s). Applications are subject to review and approval and are not guaranteed. Your application should include the rationale and history of the encroachments, where applicable.
