Database description: Contains the Revised Charter of Honolulu in full-text as compiled and converted into electronic form by the 1998 Charter Revision Commission staff, and maintained by the Corporation Counsel. Each section is placed in a separate file; for example, Section 1-101 is in file RC010101.pdf. A list of files by section is included in the database. The Revised Charter 2000 Edition, 2003 Supplement is further revised by the following amendments, listed in chronological order:
The Revised Charter was revised by the approval of the electorate of three Charter amendments in the 2004 General Election, initiated by Council Resolution:
- Resolution No. 04-18, Initiating Amendments to the Revised Charter Concerning the Neighborhood Commission;
- Resolution No. 04-113, CD2, Initiating Amendments to the Revised Charter Relating to a Temporary Replacement for a Councilmember Called to Active Military Duty; and
- Resolution No. 04-178, CD2, FD1, Initiating an Amendment to the Revised Charter Relating to the Convening of the Charter Commission.
The Revised Charter was further revised by the approval of the electorate of eight Charter amendments in the 2006 General Election, initiated by the following proposals of the 2005-06 Charter Commission:
- Charter Question #3, adding a new Section 9-204. Clean Water and Natural Lands Fund and Affordable Housing Fund;
- Charter Question #4, amending Section 6-803 to include language regarding curbside recycling;
- Charter Question #5, amending Section 11-106 and Section 11-107, to include language regarding civil fines for ethics violations;
- Charter Question #6, amending Section 13-116, to include language regarding special elections;
- Charter Question #8, amending Section 6-1703, to include language regarding bikeways and adding a new Section 6-17__. Pedestrian and Bicycle Friendly City;
- Charter Question #10, amending Section 6-603. Powers, Duties and Functions of the director of emergency services and amending Section 6-1004. Powers, Duties and Functions of the fire chief;
- Charter Question #11, amending Section 9-106, to extend the time for capital funds; and
- Charter Question #12, amending Section 6-1202, to include language regarding additional electronic notice.
- Charter Question #12 also made housekeeping amendments to the following sections:
- Section 4-104. Appointment, Confirmation and Removal of Officers and Employees, to correct an inadvertent omission, the Director of Customer Services will be included in the list of department heads to be appointed by the Mayor with the advice and consent of the Council and may be removed by the Mayor; also, to conform to legal requirements, the Civil Defense Administrator would be deleted from the list of department heads who are appointed by the Mayor with the advice and consent of the Council and may be removed by the Mayor;
- Section 11-107. Ethics Commission, for clarification, the Charter would include a reference to the Hawaii State Constitution prohibition on Ethics Commission members from taking an active part in political campaigns;
- Section 6-1608. Political Activities Prohibited, to conform to a court decision, the unconstitutional prohibition on political campaigning by Police Department employees would be deleted from the Charter;
- Section 3-402. Procedure for Enactment and Adoption, Section 12-103. Recall Petition; Recall Election, and Section 15-101. Initiation of Amendments or Revisions, to conform to federal law, the requirement of Social Security numbers on petitions for recall, ordinances by initiative, and charter amendments would be deleted; and
- Section 13-1___. Public Notices via Electronic Medium, and Section 13-106. Public Hearings; Notice, to require that public notices would be required to be distributed via an electronic medium in addition to the requirement that public notice be published in a newspaper of general circulation.
- Additionally, the 2005-06 Charter Commission included the addition of a new Section 16-___. Effective Date of Revisions.
The Revised Charter was further revised by adoption of Council Resolution No. 07-037 on February 21, 2007, approving the proposal of the Mayor to create a Department of Emergency Management to replace the Oahu Civil Defense Agency and to implement conforming amendments to Section 6-103, pursuant to the authority of the Mayor in Section 4-202.
