AUTHORIZING THE MAYOR OF THE CITY AND COUNTY OF HONOLULU TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF HAWAII, DEPARTMENT OF TRANSPORTATION, FOR THE OPERATIONAL AND MAINTENANCE CONTROL OF TRAFFIC SIGNAL SYSTEMS LOCATED ON STATE'S HIGHWAY FACILITIES ON OAHU.

    WHEREAS, pursuant to Chapter 1, Article 9, Revised Ordinances of Honolulu 1978, as amended, any intergovernmental agreement or amendments thereto which places an obligation upon the City and County of Honolulu or any department or agency thereof requires prior City Council consent and approval; and

    WHEREAS, the State of Hawaii wishes to delegate operational and maintenance control of all traffic signals located on the State's highway facilities on Oahu to the City and County of Honolulu; and

    WHEREAS, the State has agreed to reimburse the City and County of Honolulu for any costs incurred by it in the operation and maintenance of the state-owned traffic signal system via regular monthly payments to the City; and

    WHEREAS, the State of Hawaii has agreed to indemnify and hold harmless the City and County of Honolulu from and against all legal claims arising out of the City's operational and/or maintenance control of said state-owned traffic signal systems, except those claims arising out of gross negligence or willful misconduct of the City; now, therefore,

    BE IT RESOLVED by the Council of the City and County of Honolulu that the Mayor be, and is, hereby authorized to enter into an intergovernmental agreement with the State of Hawaii, Department of Transportation, for the operational and maintenance control of traffic signal systems located on the State's highway facilities on Oahu; and

    BE IT FURTHER RESOLVED that the agreement be in substantially the same form as the attached; and

    BE IT FINALLY RESOLVED that the Clerk is directed to transmit certified copies of this Resolution to the State Director of Transportation and City Director of Transportation Services.
