CONCERNING PARKS WHICH MAY BE TRANSFERRED OR EXCHANGED BETWEEN THE CITY AND STATE.

    WHEREAS, the county councils and administrations, under the auspices of the Hawaii State Association of Counties, have agreed to certain policies concerning the jurisdictional division of highways and parks between the State and counties; and

    WHEREAS, the policies are to be transmitted to the Governor for consideration by the State; and

    WHEREAS, among the policies are the following:

        (1)    Highways and parks may be transferred or exchanged between the State and each county on a case-by-case basis as deemed in the public interest. Each county may establish its own criteria or method of determining the highways and parks which should be under county jurisdiction and those which should be under State jurisdiction; and

        (4)    Each county shall notify the State of the highways and parks which are candidates for transfer or exchange between the jurisdictions;

and

    WHEREAS, for purposes of information and consolidated transmittal to the Governor, the Executive Committee of the Association has requested each county to identify highways and parks which are candidates for transfer or exchange between the jurisdictions; now, therefore,

    BE IT RESOLVED by the Council of the City and County of Honolulu that the following policies shall be the criteria for determining the parks which should be under county jurisdiction and those which should be under State jurisdiction:

     (1)    Areas or sites which attract island-wide residents and/or tourists and have significant cultural or natural values shall be the responsibility of the State.

    (2)    Areas or sites without significant cultural or natural values shall be the responsibility of the City.


    (3)    Areas or sites used primarily by community residents with a high component of active recreational uses shall be the responsibility of the City.

    (4)    For cost or other reasons in the public interest, the City may refuse to:

        (A)    Accept a State park which, under the policies, should be a City responsibility; or

        (B)    Transfer a City park which, under the policies, should be a State responsibility;

and

    BE IT FURTHER RESOLVED that the attachment to this Resolution list the parks which are candidates for transfer or exchange between the State and City pursuant to the policies; and

    BE IT FURTHER RESOLVED that the identification of candidates for transfer or exchange under this Resolution be for information purposes only, and any transfer or exchange of a specific park shall be subject to Council review and approval, unless otherwise provided by law; and


    BE IT FINALLY RESOLVED that the Clerk be, and he is hereby, directed to transmit a certified copy of this Resolution to the Governor of the State of Hawaii, Mayor of the City and County of Honolulu, President of the Hawaii State Association of Counties, and City Director of Parks and Recreation.

    1.    Kawainui Marsh, except the community park area and the model airplane field.

    2.    Koko Head Regional Park, except the district park, rifle range, riding stable, botanic gardens, and Hanauma Bay.

STATE PARKS TO CITY

    1.    Honolulu Stadium Park.

    2.    Sans Souci State Recreation Area.

    3.    Aina Moana (Magic Island) State Recreation Area.

    4.    Sand Island State Recreation Area.

    5.    Rainbow Bay State Recreation Area.

    6.    Kakaako State Recreation Area.
