ESTABLISHING CONTRACTING POLICIES TO ASSIST MINORITY, DISADVANTAGED AND WOMEN'S BUSINESSES IN THE CITY AND COUNTY OF HONOLULU.

    WHEREAS, Federal law relating to the Urban Mass Transportation Administration (UMTA) currently provides that at least 10 percent of any Federally-funded contract, or partially Federally-funded contract, be expended with small business concerns that are owned and operated as a minority business enterprise by socially and economically disadvantaged minorities or women; and

    WHEREAS, Minority Business Enterprise (MBE), Disadvantaged Business Enterprise (DBE), and Women's Business Enterprise (WBE), are currently defined in Federal law as those business enterprises with at least 51 percent ownership and control by one or more socially disadvantaged persons, i.e., minorities or women; and

    WHEREAS, in Hawaii, our minority or "disadvantaged" population is different, in overall ethnicity, from that of the mainland United States; and

    WHEREAS, the University of Hawaii's William S. Richardson School of Law and John A. Burns School of Medicine have, in that knowledge, identified -- for the purposes of minority admittance -- Hawaiians, part-Hawaiians, Filipinos, Pacific Islanders, and women; and

    WHEREAS, at present, neither the Counties of the State of Hawaii nor the State has policies reflecting the reality of Hawaii's underrepresented, for the purposes of the awarding of County or State contracts; and

    WHEREAS, assistance in contracting policies to the true minorities and disadvantaged groups of the City and County of Honolulu would assist in stimulating and encouraging such minority, disadvantaged or women's businesses; and

    WHEREAS, a goal of at least 10 percent of expenditures on City contracts being expended upon minority, disadvantaged and women's businesses is a reasonable and attainable one; now, therefore,

    BE IT RESOLVED that the City Council of the City and County of Honolulu urges the City Administration to formulate rules and regulations with respect to the award of City contracts to groupsthat are truly minorities or disadvantaged and to women in the City and County of Honolulu; and

    BE IT FURTHER RESOLVED that the City and County of Honolulu hereby establishes the policy that at least 10 percent of all monies expended on City contracts, or any subcontracts emanating therefrom, be expended with minority or disadvantaged business enterprises, i.e., businesses 51 percent owned and controlled by Hawaiian (or part-Hawaiian), Filipino, Pacific Island and women businesspersons, so as to fulfill the spirit of Federal UMTA law and to provide stimulus and encouragement of business opportunities to these groups; and


    BE IT FINALLY RESOLVED that the Clerk shall transmit copies of this resolution to the Mayor, the Managing Director and the Director of Finance of the City and County of Honolulu.
