EXPRESSING THE APPROVAL OF THE COUNCIL OF THE CITY AND COUNTY OF
HONOLULU ON A PROPOSED AMENDMENT TO THE RULES OF THE DIRECTOR OF
CIVIL SERVICE.
WHEREAS, Section 79-12 of the Hawaii Revised Statutes
provides for the promulgation of rules and regulations relating
to leaves of absences by the Civil Service Director, subject to
the approval of the Council; and
WHEREAS, the Council of the City and County of Honolulu
wishes to revise the leave of absence policy of the City through
the adoption of a resolution;
WHEREAS, the current rule relating to leaves of absence of
exempt employees is not consistent with other leave rules of the
City, and provides different treatment for exempt employees
versus civil service employees; and
WHEREAS, there is nothing in the applicable rules which
justifies the disparate treatment of such employees; and
WHEREAS, the Corporation Counsel advises that the current
rule should be rescinded; and
WHEREAS, a public hearing on the deletion of the rule was
held and no comments nor objections were received at the public
hearing; now, therefore,
BE IT RESOLVED by the Council of the City and County of
Honolulu that Rule 5.3, "Reappointment of Employee," of the Rules
of the Director of Civil Service as stated below, be repealed.
Rule 5.3 presently states: When an appointed or elected officer exempted from civil service is entitled to vacation or sick leave allowance and such officer is reappointed or reelected to the same office or position, at the expiration of the term of such office or position or is elected or appointed to any other office or position and such officer assumes such office or position without delay following such reappointment, reelection, appointment, or election, such officer shall not forfeit any previously accrued or accumulated vacation or sick leave allowance. Such an officer may request and be entitled to cash payment for all vacation credits accumulated as of the last day of office or employment prior to the reappointment or reelection. Such cash payment shall be computed on the basis of a month's salary for each 20 days of accumulated vacation, and
BE IT FURTHER RESOLVED by the Council of the City and County
of Honolulu that the Clerk is hereby directed to transmit this
Resolution to the Mayor, the Director of Civil Service and the
Corporation Counsel.
