AUTHORIZING THE DEPARTMENT OF THE CORPORATION COUNSEL

TO REPRESENT THE FAMILY COURT IN ANY CONTEMPT

PROCEEDING FOR THE ENFORCEMENT OF ANY

CHILD SUPPORT OR SPOUSE SUPPORT ORDER

    WHEREAS, the Family Support Division of the Department of the Corporation Counsel has long performed a significant service in our community through the establishment of paternity of children born out of wedlock and securing and enforcing support for them; the initiation and enforcement actions brought under the Uniform Reciprocal Enforcement of Support Act; the enforcement of support orders relating to divorce and other matrimonial actions; and the representation of the Family Court in enforcement of support orders; and

    WHEREAS, the role of the Department of the Corporation Counsel, Family Support Division in the enforcement of support orders is confirmed and mandated by Sections 580-15, 346-39, Chapter 576 and Chapter 584 of the Hawaii Revised Statutes; and

    WHEREAS, a legal question has been raised as to the authority of the Department of the Corporation Counsel, Family Support Division, to represent the Family Court in any contempt proceeding for the enforcement of any child support or spouse support order; now therefore,

    BE IT RESOLVED by the Council of the City and County of Honolulu that the Department of the Corporation Counsel, Family Support Division, has been and continues to be authorized, as described in Section 580-15 of the Hawaii Revised Statutes, to represent the Family Court in the enforcement of any child support or spouse support order; and

    BE IT FURTHER RESOLVED that the Department of the Corporation Counsel, Family Support Division, has been and continues to be authorized to provide legal services to both welfare and non-welfare families in our community through its activities to establish the paternity of children born out of wedlock and securing and enforcing support for them; to initiate and enforce support under the Uniform Reciprocal Enforcement of Support Act; and to enforce support orders relating to divorce and other matrimonial actions; and


    BE IT FURTHER RESOLVED that the Clerk be directed to forward a copy of this Resolution to the Department of the Corporation Counsel and to District Family Court Judge Michael A. Town.
