WHEREAS, the control of traffic signals on Oahu is presently
divided between the State of Hawaii and the City and County of
Honolulu in accordance with the respective classification of
highways; and
WHEREAS, the State and City desire to unify the control of
traffic signals by transferring the control, operation and
maintenance of traffic signals on State Highways on Oahu to the
City; and
WHEREAS, Section 111-48, Revised Laws of Hawaii 1955, as
amended, authorizes the State and the City to enter into such an
agreement of transfer; and
WHEREAS, the term of such agreement would be for an
indefinite period, possibly exceeding the period of appropriation
of funds for such agreement in contravention of Charter Section
9-405.2; and
WHEREAS, Charter Section 12-119 authorizes the Council to
waive upon recommendation of the Mayor any provision of the
Charter when it finds that the application thereof may jeopardize
the receipt of federal funds; and
WHEREAS, the Mayor has recommended the waiver of Charter
Section 12-119 because many of the transferred traffic signals
are located on federal aid highways and the continued maintenance
thereof is necessary in order not to jeopardize the receipt of
federal funds; now, therefore,
BE IT HEREBY RESOLVED by the Council of the City and County
of Honolulu that the provisions of Charter Section 9-405.2,
prohibiting the entering of an agreement which extends beyond the
term of appropriation financing such obligation, is hereby waived
as to the agreement between the State of Hawaii and the City and
County of Honolulu transferring the control of traffic signals on
State Highways on Oahu to the City; and
BE IT FURTHER RESOLVED that the Mayor be authorized to execute such agreement.
