RELATING TO THE MILILANI HIGH TECHNOLOGY PARK/WAHIAWA ENTERPRISE ZONE NO. 2.

    WHEREAS, the State offers a program under which areas with certain low-income or high unemployment population levels may be designated as enterprise zones; and

    WHEREAS, after designation, eligible businesses that employ a specified average number of persons may qualify for State and local tax and other benefits; and

    WHEREAS, under State law, the establishment of an enterprise zone must be first proposed by a county and then approved by the Governor; and

    WHEREAS, one of the enterprise zones in the City and County of Honolulu is the Mililani High Technology Park/Wahiawa Enterprise Zone No. 2; and

    WHEREAS, the Mililani High Technology Park/Wahiawa Enterprise Zone was proposed by the Council under Resolution 95-292, CD1, with the concurrence of the Mayor, and approved by the Governor on October 14, 1996; and

    WHEREAS, in general, the Enterprise Zone is comprised of the Mililani High Technology Park and certain appropriately zoned areas of Wahiawa; and

    WHEREAS, the Council has received a request to expand the Mililani High Technology Park/Wahiawa Enterprise Zone; and

    WHEREAS, Section 31-1.3, Revised Ordinances of Honolulu 1990, authorizes the Council, with the concurrence of the Mayor, to propose the amendment of an existing enterprise zone; and

    WHEREAS, Section 15-6-7, Hawaii Administrative Rules, requires gubernatorial approval of such an amendment; and

    WHEREAS, the Council finds that the proposed expansion of the Mililani High Technology Park/Wahiawa Enterprise Zone will serve the public interest because of the resultant additional opportunities for economic development and employment; now, therefore,

    BE IT RESOLVED by the Council of the City and County of Honolulu that the Mililani Technology Park/Wahiawa Enterprise Zone No. 2 be expanded by the addition of the area shown on the attached Exhibit A; and

    BE IT FURTHER RESOLVED that the local incentives to be provided to qualified business in the expanded area shall be the same as those specified in Resolution 95-292, CD1, namely:

(1)    A rebate of real property taxes on all new construction for a period not to exceed two years; and

(2)    A waiver of all fees for building and grading permits required for new construction for a period of seven years;

and

    BE IT FURTHER RESOLVED that the Mayor is requested to concur with the expansion of the Mililani High Technology Park/Wahiawa Enterprise Zone and transmit the application for the expansion to the Governor; and

    BE IT FURTHER RESOLVED that the Governor is requested to approve the application for the expansion; and


    BE IT FINALLY RESOLVED that the Clerk is directed to transmit certified copies of this Resolution to the Governor of the State of Hawaii, Mayor of the City and County of Honolulu, and Director of the State Department of Business, Economic Development, and Tourism.
