CITY AND COUNTY OF HONOLULU
DEPARTMENT OF PARKS AND RECREATION

    Under and by virtue of the authority conferred upon her by Chapter 91, Hawaii Revised Statutes (HRS), Article 14, Chapter 13, Revised Ordinances of Honolulu 1978 (ROH), and every other enabling power, the Director of Parks and Recreation of the City and County of Honolulu does hereby prescribe the following:

RULES AND REGULATIONS
GOVERNING RECREATIONAL STOPS BY COMMERCIAL
TOUR COMPANIES IN CITY PARKS

PART X


    Section 56. Findings and Purpose. Pursuant to Ordinance 82-28 and Section 8 of these rules and regulations, a public hearing was conducted to determine the propriety of recreational stops by commercial tour companies in City parks located in other than State Conservation Districts. As a result of the public hearing, the Department finds the proposed recreational stops to be essentially recreational in nature and complementary to the facilities of the parks.

    These activities are hereby designated authorized activities in accordance with the definition provided in these rules and regulations, subject to the limitations and conditions hereinafter described.

    Section 57. Permits for Recreational Stops.

    (a)    Recreational stops shall mean the use of City parks by commercial tour companies for activities extending beyond 15 minutes but not exceeding 90 minutes. Such activities may include but shall not be limited to, sightseeing, spectating, picture taking, beach combing, swimming and the eating of prepared picnic lunches.

    (b)    Recreational stops at City parks shall be allowed daily, weekends and holidays included, between the hours from sunrise to sunset, and only by permit issued by the Department. Stops by tour buses and tour vans which are allowable without a permit are those stops which do not exceed 15 minutes in duration.

    (c)    Commercial tour companies shall secure an annual or monthly permit for each vehicle they use for recreational stops at City parks.

    (d)    Permits shall be displayed in plain view on the dashboard of the vehicle while it is on City parks property and shall be presented, upon request, to any Department representative or police officer.

    (e)    Permits for recreational stops shall not be issued for City parks which are located in State Conservation Districts.

    Section 58. Fees.

        See Chapter 27, ROH 1978, as amended.

    Section 59. General Conditions.

    (a)    The applicant for permit must possess the licenses required to conduct business in the State of Hawaii.

    (b)    The applicant for permit must have in current force and effect an insurance policy in which the combined limit of liability for bodily injury and property damage is $1 million per occurrence. The insurance certificate shall name the City and County of Honolulu, its officers and employees, and the State of Hawaii, its officers and employees, as additional insured. A copy of the certificate of insurance shall be filed with the Parks Permit Section of the Department.

    (c)    No more than three commercial tour vehicles making recreational tours may be parked in any City park at any time.

    (d)    There shall be no cooking or preparation of food on City parks property.

    (e)    Buffet or serving lines shall not be permitted.

    (f)    The use of any catering service on City parks property is prohibited.

    (g)    Prepared lunches which do not require buffet or serving lines may be brought in by the tour group.

    (h)    There shall be no reserving of picnic sites and tables.

    (i)    There shall be no advertising, soliciting or selling on City parks property.

    (j)    There shall be no distribution of food or refreshments to other park users without approval by the Director.

    (k)    Litter generated by the commercial tour group shall be picked up and placed in trash receptacles.

    (l)    All commercial tour vehicles and drivers shall be licensed under Public Utilities Commission rules and regulations.
