GOVERNING HELICOPTER AND PARACHUTE LANDINGS ON CITY AND COUNTY OF HONOLULU PARK PROPERTIES Pursuant to and by virtue of the authority set forth in Section 13-14.3, Revised Ordinances of Honolulu 1978, as amended, and Chapter 91, Hawaii Revised Statutes, the Director of the Department of Parks and Recreation, subject to the approval of the Mayor of the City and County of Honolulu, adopts the following rules and regulations governing helicopter and parachute landings on public parks of the City and County of Honolulu.
A. Applicability and Scope 1. These rules and regulations shall apply to helicopter and parachute landings on public parks under the control, management and operation of the Department of Parks and Recreation, hereinafter called Department. 2. If any provision of these rules and regulations, or the application of such provision is held to be invalid, the remaining portions of these rules and regulations or the application of said portions shall not be affected. 3. These rules and regulations shall not apply to emergency landings or for rescue, search, medivac, criminal apprehension/detection and emergency/disaster survey purposes. B. Objectives 1. To promote the health, safety and welfare of the public and, in particular, City park users. 2. To protect and preserve park facilities and to promote the safe enjoyment of them by park users. C. Penalties Any person found in violation of these rules may be subjected to a fine of up to five-hundred dollars ($500.00) or by imprisonment for up to thirty days, or both, such fine and imprisonment, for each violation. A. Permit Procedures 1. Helicopter and parachute landings on City park properties shall be allowed only by permit issued by the Department's Permit Section. 2. Helicopter and parachute landings shall not be allowed on City parks under the following circumstances: a. During hours of darkness, including dawn and dusk. b. On any City park designated as a campground or operated as a zoo site. c. At any other time when the Department determines there would be jeopardy to public safety and health. 3. All permit applicants, except for the Honolulu Fire Department, Honolulu Police Department, and State and Federal agencies, shall obtain general liability insurance coverage in the following minimum amounts: Bodily injury - $1,000,000 per occurrence Permittees shall present to the Department a certificate of such insurance coverage which shall name the City and County of Honolulu as an additional insured. 4. Permittees shall be responsible for crowd control at landing sites and shall provide adequate barricades and/or security personnel for safety purposes. 5. Permittees shall be responsible for immediately repairing, to the satisfaction of the Department, any damages to grounds, irrigation fixtures or structures caused by helicopter and parachute landings or by personnel related to either activity.
