RELATING TO DOGS IN CITY PARK PROPERTIES DEPARTMENT OF PARKS AND RECREATION 1. General Provisions 1.1. Definitions a. The following words or terms shall have these meanings unless the context clearly indicates otherwise: 1. Department - Department of Parks and Recreation, City and County of Honolulu. 2. Director - The Director of Parks and Recreation. 3. Park - To include all recreation parks, beach parks, beach rights-of-way, circles, fields, golf courses, botanical gardens, lookouts, parkways, parks, promenades, squares, triangles, zoo, flower gardens, fountains and other like facilities, which are under the jurisdiction of the City and County of Honolulu. 1.2. Prohibition of Dogs. a. Within the limits of any public park, it shall be unlawful for any person to permit any dog, except as hereinafter provided, to enter and remain within the confines of any park area. 2. Exceptions 2.1. Dog Shows, Trials and Obedience Classes, Seeing Eye, and Police Dogs. a. Dog shows and trials and obedience classes shall be allowed only by Department permit. A deposit of $100 shall be required prior to the issuance of any permit. b. Seeing Eye dogs trained to assist blind persons when such dogs are actually being used by blind persons for the purpose of aiding them in going from place to place. 2.2. Permit Procedure. a. Permits to hold dog shows and obedience classes and trials shall be issued at the Parks Permit Section, located on the ground floor of the Honolulu Municipal Building, 650 South King Street, on weekdays from 7:45 a.m. to 4 p.m. b. Application for permits must be made at least three months before the show, class, or trial is to be held. 2.3. Conditions of Permit. a. Permittees shall comply with the following conditions: 1. While using park areas, the permittee or his authorized representative must have the permit at all times and shall exhibit it to any department personnel or police officer upon request. 2. The permittee or his authorized representative shall be responsible for the restoration of the site to its original condition except for ordinary wear and tear. 3. The permittee shall be responsible for the proper control of all dogs on the site. b. Organizations using park facilities and/or areas are required to obtain insurance in the following amounts: $100,000 for injury to one person; The City shall be named as additionally insured. 2.4 Revocation of Permit. a. The Director or his authorized representative may revoke a permit in accordance with Section 13-14.3(c), Revised Ordinances of Honolulu 1978, as amended, for any violation of these rules or of any law applicable to dogs.
3. Areas for Dogs. 3.1. Director to Designate Areas. a. The Director may designate parks or areas within parks wherein dogs are permitted. The areas shall be identified by appropriate signs. 3.2. Rules Governing Use of Areas. a. Handlers of leashed dogs shall abide by the following rules and regulations: 1. The handler shall have control of his dog at all times, and the dog must be leashed except when performing at dog shows and during training in a dog obedience class or at trials. 2. The handler is responsible for picking up and disposing of any and all visible dog feces left by the dog. 3. The handler shall obey all park signs posted in the park. 3.3. Stray Dogs on City Park Properties a. Any dog running at large on City park property shall be seized and impounded by the Hawaiian Humane Society, or by any officer authorized by law, and shall be disposed of in accordance with the provisions of Chapter 143, HRS, and the owner or person responsible for the dog shall be issued a summons in accordance with Article 13, Revised Ordinances of Honolulu, 1978, as amended. 4. Penalties. 4.1. Provisions of Section 13-14.6 to Govern. a. Any person violating the foregoing rules and regulations shall be subject to the provisions of Section 13-14.6, Revised Ordinances of Honolulu, 1978, as amended.
