MOTORIZED AND GLIDER MODEL AIRPLANE ACTIVITIES ON CITY PARK PROPERTIES Pursuant to and by virtue of the authority set forth in Section 13-14.3, Revised Ordinances of Honolulu 1978, as amended, and in Chapter 91, Hawaii Revised Statutes, the Director of the Department of Parks and Recreation, subject to the approval of the Mayor of the City and County of Honolulu, hereby adopts the following Amended Rules and Regulations Governing Motorized and Glider Model Airplane Activities on City Park Properties.
A. Applicability and Scope. 1. These rules and regulations shall apply to City park areas owned or under control of the Department of Parks and Recreation, City and County of Honolulu, which have been designated for model airplane flying. 2. If any provision of these rules and regulations or the application of such provisions is held to be invalid, the remaining portions of these regulations or the application of said portions shall not be affected. B. Definitions. The following definitions shall apply to the provisions contained in these regulations: 1. "AMA" shall mean the Academy of Model Aeronautics. 2. "Applicant" shall mean the person or organization who has filed an application for permit. 3. "Department" shall mean the Department of Parks and Recreation of the City and County of Honolulu. 4. "Designated City Parks" shall mean City parks designated as flying fields for model airplanes by the Department of Parks and Recreation. 5. "Director" shall mean the Director of the Department of Parks and Recreation, City and County of Honolulu. 6. "Free Play" shall mean other than meets, races, or competitions and where a permit or insurance is not required.
8. "Motorized Model Airplane" shall mean a scaled- down version of any regular full-sized aircraft which is propelled by a motor and controlled remotely by radio or directly. 9. "Permit" shall mean a Park Use Permit issued by the Parks Permit Section, Department of Parks and Recreation, authorizing use of a designated City park property for model airplane meets, races, or other competitive events. 10. "Permittee" shall mean the person or organization to whom a permit has been issued. 11. "Pre-flight Area" shall mean the safety zone where pre-flight operation is conducted.
A. Permit Procedure for Meets, Races, Competitions. 1. Model airplanes may be flown only in designated City parks. Refer to attachment for a list of designated City parks. 2. Any person or organization desiring to conduct a model airplane meet, race or other type of competition in a designated City park shall first file an application with the Parks Permit Section, 650 South King Street, Honolulu, Hawaii 96813. 3. All applications for permits shall be filed with the Parks Permit Section no later than 30 days prior to the date of the event. 4. The applicant shall be responsible for controlling and monitoring noise levels generated by the motorized model airplanes and public address systems to comply with the 80 dba noise limits as established by the State Department of Health. 5. The applicant shall arrange for the delivery of portable sani-toilets at flying fields where there are no comfort stations. 6. No permit shall be issued unless the applicant meets the following conditions. a. Present a Certificate of Insurance naming the City and County of Honolulu as flying site owner/additional insured and showing public liability coverage of not less than $300,000 per occurrence for bodily injury and $300,000 per occurrence for property damage. b. Agrees to employ security personnel for crowd and parking controls when required by the Director. c. Agrees to see that all pilots comply with AMA established safety rules, all pre-flight operations are conducted within a designated pre- flight area, and that, except for the pilot in command, all others are to remain within a designated spectator area. B. Free Play. 1. Model airplanes may be flown only in designated City parks. Refer to attachment for a list of designated parks. 2. A permit is not required for free play. 3. Free play may be allowed any time, except during model airplane meets, races, or competitions and where a valid permit has been issued for football, soccer, etc. 4. Free players shall exercise safety precautions at all times. No flying of model airplanes is permitted among or above spectators, picnickers, and other park users. C. Other Provisions. 1. Except as authorized by special permit, there shall be no selling, soliciting, advertising, etc., on City park properties. 2. There shall be no driving or parking on grassed areas. 3. Model airplane field users shall clean the area of any litter they generate. 4. Modification or alteration of flying fields is not allowed without prior written approval from the Director. 5. Permittees shall observe the time limitations stated on the permit. 6. Model airplane field users shall not willfully or intentionally destroy, damage, or injure any plant life or property.
