Reconsideration of Motion: Property Tax Resolution presented to board in February 2008 Sustainability and Environmental Committee Motion 1 – Resolution: Whereas, Kailua (Neighborhood Board #31) is a residentially zoned area with no resort facilities and carrying capacity limited by a finite infrastructure, Whereas, the Koolaupoko Sustainable Communities Plan (“SCP”) emphasizes the need and requirement to protect the integrity of residential neighborhoods in, among other places, Whereas, its residents purchased their homes with this implicit trust and thus expected that their town center, community and neighborhoods would at no time be promoted as a tourist destination, and this type of promotion is contrary to the SCP, Whereas, Kailua residents pay state property taxes in good faith and with the reliance that the State of Hawaii, its representatives, and agencies will not take action nor allow action that is detrimental to the integrity of residential neighborhoods, Whereas, non-permitted or illegal TVRs are operating in Whereas, water-sport equipment rental businesses have set up non-permitted operations in Kailua Beach Park, its beach and waters, and at public right-of-ways in Kailua (including Kalama Beach and Lanikai) which have no lifeguards, public facilities, or parking, Whereas, these non-permitted and/or illegal business operations are featured on the website and editorial/advertising materials of the Be It Resolved, that the Kailua Neighborhood Board views such actions as contrary to the SCP and strongly opposes the use of public monies by the Hawaii Tourism Authority and the HVCB and Convention Bureau which have the affect of promoting illegal, non-permitted or non-compliant businesses and activities which are a detriment to the residential environs of Kailua. Be It Further Resolved, that the Motion 2: In recognizing the need for accurate information to the Hawaii-bound traveler as well as the need to protect residential zoning, the Transportation and Public Works Committee Motion: The KNB requests the City and County to install speed bumps on the 400 block of Iliaina Street as requested by petition of 22 of 28 the residents. Public Health, Public Safety & Civil Defense Committee Motion: The Parks and Recreation Committee: Motion: The for violations on public lands with increased civil penalty fine amounts for violations on public lands and clarification of penalties for encroachment on public lands. Executive Committee: Motion 1 - The KNB supports reinstating $20,000 into the Neighborhood Commission Office budget for Olelo webcasting for neighborhood boards. Motion 2 - The KNB supports the Mililani Neighborhood Board resolution which opposes term limits for neighborhood board members. Non-Committee Motions: Motion 1 – The KNB supports the intent of the following bills which are consistent with the board’s position to improve beach access: · HB 839 relating to public access to beaches · HB 3265 RELATING TO PUBLIC ACCESS TO COASTAL AREAS · HB 2991 RELATING TO BEACHES · HB 2578 RELATING TO BEACHES · SB 2835 RELATING TO PUBLIC ACCESS · SB 2836 RELATING TO PUBLIC ACCESS · HB2332 relating to public lands Motion 2 – The KNB opposes SB 2059 (relating to information practices) in an effort to continue protecting the consumer VIII.
