Advisory Opinion No. 58

This is in response to your letter of March 19, 1976, requesting this Commission to review the consequences of the promotion given to Employee X because he has a real estate salesman's license.

We understand the salient facts to be as follows:

1. Employee X was formerly a staff assistant to the Division Head and was promoted to Assistant Division Head.

2. This Commission issued Advisory Opinion No. 46 on October 30, 1975 concerning Employee X, stating that his retention of a real estate salesman's license did not violate any of the provisions of the standards of conduct in the Revised Charter or the Revised Ordinances.

Based on the testimony of Employee X, a review of his revised job description, and functions of the division of which he is a member, we are of the opinion that there is no apparent conflict of interest. However, we caution that the caveat contained in Opinion No. 46 be observed by Employee X.
