Advisory Opinion No. 42

This is in reference to the disclosure of conflict of interest submitted by you.

We are of the opinion that there is no conflict of interest under the facts related to this Commission. The facts, as presented by you, were:

1. That you have an agency relative to the sale of an automotive radiator cleansing device and other related products;

2. That you have a part time salesman selling said product and an arrangement with the dealers; and

3. That your primary function in relation to said agency as owner and as administrator of such agency includes direct sales by you.

In view of the foregoing we conclude that under the foregoing circumstances any conflict of interest arising in connection with your employment with the City is remote. We, however, caution that in the event that you make any sales to the City that such sales be subject to public bidding as provided in Section 7-15.2(e), R.O. 1969.
