Advisory Opinion No. 41
This is in reference to the disclosure of conflict of interest submitted by Officer X of the Building Department.
We are of the opinion that there is no conflict of interest under the facts related to this Commission by Officer X.
Officer X related that the interest he has in a family corporation primarily concerns his wife and her relatives.
Moreover, the amount of interest owned by his wife is minimal and not large enough to indicate a controlling interest. He also testified that the primary asset of said family corporation, of which Officer X has an interest, is a single parcel of land in Wai‘anae which has a business structure thereon.
In view of the foregoing we conclude that the interest involved in this disclosure is remote as to create a conflict of interest and any review by City agencies for land development applications or building permits of the real property which is the primary corporate asset is remote.
