Advisory Opinion No. 37

This is in reference to the disclosure of outside employment submitted by Employee X who is employed as an Engineering Aid.

After reviewing the statements in the disclosure and interrogating Employee X, the Ethics Commission has found that:

1. Employee X's wife has interest in land developments conducted by Y Development Co.;

2. As an Engineering Aid, Employee X is primarily connected with surveying the land which the City intends to acquire; and

3. Employee X's position does not involve review of plans or any decision making whether or not Y Development Co. purchases meet established statutes, ordinances, or rules and regulations.

In view of the foregoing, the Ethics Commission concludes that there is no conflict of interest in connection with the interest held in Y Development Co. by Employee X's wife.
