Advisory Opinion No. 26

This is in reference to the code of ethics disclosure submitted by Employee X, Housing-Zoning Code Inspector.

The disclosure reveals that Employee X is employed by the City and County of Honolulu as a code enforcement official. It further discloses that he works part time as a bookkeeper for a masonry contractor.

The Ethics Commission concurs with the department head's finding that there is no conflict of interest in the instant case. As a caveat, however, we request that you inform the department head to advise Employee X that Employee X shall at no time inspect any masonry work done by said contractor. Any inspection by Employee X of said contractor's work will be deemed to be a conflict of interest.
